If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Breakage is a personal, non-commercial side project provided free of charge. It is designed to help users track credit card perks and benefits for informational purposes only. The Service is offered "as-is" and "as-available" without any warranties or guarantees of any kind.
The Service is not affiliated with, endorsed by, or associated with any credit card issuer, bank, airline, hotel chain, or loyalty program. All program names, card names, and trademarks belong to their respective owners. Perk information displayed may be inaccurate, incomplete, or outdated.
NOTHING IN THE SERVICE CONSTITUTES FINANCIAL, INVESTMENT, TAX, LEGAL, OR PROFESSIONAL ADVICE. Credit values, perk deadlines, and other information are approximations that may be inaccurate, outdated, or inapplicable to your specific situation. The Operator makes no representation that any information reflects the actual terms, conditions, or value of your credit card benefits.
You should not make financial decisions based solely on information provided by the Service. Always verify perk terms, deadlines, and values directly with your card issuer before making any financial commitment. The Operator is not responsible for any missed perks, expired credits, or financial losses arising from use of or reliance on the Service.
The Service calculates and displays information based on data you input. The Operator is not responsible for the accuracy, completeness, or currency of any data you enter, nor for any decisions made in reliance on outputs derived from that data. You are solely responsible for ensuring the data you provide is accurate and for verifying all information independently with your card issuers.
You agree to use the Service only for lawful personal purposes. You may not:
Access to the Service requires authentication via Google Sign-In. You are responsible for maintaining the security of your Google account and for all activity that occurs under your account. You may delete your account and associated data at any time through the Settings page within the app.
The Operator reserves the right to suspend or terminate your access to the Service at any time, for any reason or no reason, including but not limited to violation of these Terms, without prior notice and without liability to you. Upon termination, your right to use the Service ceases immediately. You may terminate your use of the Service at any time by deleting your account through the Settings page.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, TITLE, NON-INFRINGEMENT, OR QUIET ENJOYMENT. THE OPERATOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION PROVIDED IS ACCURATE OR COMPLETE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE OPERATOR'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED ONE DOLLAR ($1.00 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless the Operator from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit to the Service.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and the Operator agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
CLASS ACTION WAIVER:YOU AND THE OPERATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Arbitration shall be administered by JAMS under its Streamlined Arbitration Rules and Procedures, and shall take place in San Francisco, California, or by telephone or video conference at your election. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court of competent jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in San Francisco County, California.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE OPERATOR WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect.
The Operator reserves the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The "Last updated" date at the top of this page will reflect any changes.
